WIFU Endowed Chair for Family Business Law

About us

The WIFU Endowed Chair for Family Business Law is a law chair at Witten/Herdecke University. It forms the legal research pillar within the Witten Institute for Family Business.

Our topics

According to the prevailing view in legal scholarship, the existence of family business law as a distinct legal discipline is disputed. This is due to the fact that the law does not recognise the concept of a family business and therefore does not, at any point, attach any explicit legal consequences to the existence of a family business. Nevertheless, family businesses do exhibit distinctive features from a legal perspective: from the point of view of civil law, the intertwining of family interests with business interests has implications for the legal treatment of the business. This stems, on the one hand, from the fact that the law of family businesses constitutes an interdisciplinary legal field which is unique in its own right. On the other hand, the subject matter raises distinct legal issues that arise in this form solely within family businesses. Finally, the involvement of family members in businesses has far-reaching tax implications which, even beyond the issue of succession, are a recurring concern in practice.
